Scope
These Terms & Conditions govern all sales of products by WATERHEAD (Maxime Genier) via the website waterheadsport.com to consumers. By placing an order, you accept these Terms & Conditions without reservation.
Seller identity
The seller’s identity and contact details are set out in our Legal Notice.
Transparency
There is currently no European factory producing silicone swim caps at our scale. We work with trusted french intermediaries who have built long-standing relationships with manufacturers in China.
Products
Products are described and presented as accurately as possible on the Website. Photographs are for illustrative purposes and are not contractually binding. We reserve the right to modify our product range at any time.
Prices
Prices are indicated in euros (€), inclusive of VAT. WATERHEAD reserves the right to change prices at any time, but products are billed at the price in effect at the time the order is placed. Shipping costs, where applicable, are indicated before you confirm your order and added to the total price.
Orders
Orders are placed directly on the Website. An order is confirmed once payment has been validated. We reserve the right to refuse or cancel any order in the event of a genuine suspicion of fraud or an existing dispute with the customer.
Payment
Payment is due in full at the time of ordering. Payments are processed securely by Stripe / WooCommerce Payments. We do not store your card details.
Delivery
Products are delivered to the address provided when ordering. Estimated delivery times are indicated at checkout and are given for information only; WATERHEAD cannot be held responsible for delays caused by the carrier.

Legal guarantees
Regardless of any commercial warranty, the seller remains bound by the legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code).
Liability
WATERHEAD cannot be held liable for damages resulting from misuse of the products, nor for indirect damages arising from their purchase or use.

Consumer mediation
In accordance with Article L616-1 of the French Consumer Code, in the event of a dispute you may resort to conventional mediation or any other alternative dispute resolution method.
Applicable law
These Terms & Conditions are governed by French law. In the event of a dispute, and failing an amicable solution, the French courts shall have exclusive jurisdiction.
